RESOLVED – That

a)      the minutes of the Taxi and General Licensing Panel meeting held on 30 April 2019 be signed by the Chair, subject to Councillor Andy Pratt not being shown as present, and

b)      the minutes of the Licensing Committee meeting held on 13 June 2019 be signed by the Chair as a correct record.

Appointment of Deputy Chair

Minutes:

It was proposed, then duly seconded by Councillor Dave Banks and

 

RESOLVED – That Councillor Peter Tyson be appointed Deputy Chair of the Licensing Committee for the Municipal Year 2019/2020.

 

LIC 19/11

Licensing Training

Minutes:

Committee received a verbal update on Licensing training from the Public Protection Manager.

 

Members were advised that the Licensing training arranged for 13 August 2019 was cancelled at the last moment due to reasons outside the Council’s control.

This training would be re-arranged as soon as possible and Members notified.

 

It was also stated that Taxi training, to be held jointly with Allerdale Borough Council, was also to be arranged.

 

RESOLVED:- that the update on Licensing training be received and noted.

Annual Review of Guidance on Determination of All Hackney Carriage and Private Hire Licences pdf icon PDF 37 KB

Minutes:

Consideration was given to the Copeland Guidance on the Determination of all Hackney Carriages and Private Hire Licences, which was reviewed on an annual basis, the last review being in June 2018.

 

Changes to the guidance at section 1.2, 2.8 and 3.2 were highlighted and it was also stated that version and document title details would be added to the footed of each page.

 

The Public Protection Manager offered to circulate the Enforcement Action Plan for 2019-20 to the Committee.

 

RESOLVED:- that the revised ‘Copeland Guidance on the Determination of all Hackney Carriages and Private Hire Licences’ be agreed.

Exclusion of Press and Public

RESOLVED:- that pursuant to Section100(A)(4) of the Local Government Act 1972, as amended, the press and public be excluded from the meeting for the following items of business on the grounds of likely disclosure of exempt information as defined in paragraph 7 of Part 1 of Schedule 12A of the Act.

Grant of Private Hire Driver's Licence

Minutes:

A report was submitted on a request received for the grant of a Private Hire Driver’s Licence.

 

Councillors Andy Pratt and James Date declared a non-pecuniary interest at this point, due to recognising and being aware that the applicant was a driver.

 

The applicant attended the hearing and addressed the Committee.

 

RESOLVED:- that the applicant’s Private Hire Driver’s Licence be granted.

 

 

(NB: Councillor Peter Tyson left the meeting at this point)

Minutes:

Consideration was given to a report submitted on a request received for the grant of a Hackney Carriage Driver’s Licence.

The applicant attended the hearing and addressed the Committee.

 

RESOLVED:- that a Hackney Carriage Driver’s Licence be granted.

A report was submitted on a request received for the grant of a Hackney Carriage Driver’s Licence.

The applicant attended the hearing and addressed the Committee.

 

RESOLVED:- that a Hackney Carriage Driver’s Licence be refused.

Duration of Meeting

Minutes:

During consideration of the next application, it was noted that business would not be concluded within the specified 4 hours. It was therefore moved by Councillor Andy Pratt duly seconded and

 

RESOLVED:– that in accordance with Rule 22.7 Chapter 4 of the Council’s Constitution, the meeting continue until the business on the Agenda be completed.

Minutes:

A report was considered on a request received for the renewal of a Hackney Carriage Driver’s Licence.

The applicant attended the Committee hearing and addressed the Members.
