Minutes:

RESOLVED – that on a vote of 7 in favour, 3 against and 0 abstentions, the application be Approved, subject to amendment of Conditions 3 and 16 as follows:-

 

Condition 3

The car park shall be restricted for use as a park and ride facility for use by workers at and visiting associates to the Sellafield Nuclear facility and other associated sites and for no other purpose whatsoever unless prior agreement is sought in writing from the Local Planning Authority.

 

Reason

The proposal forms part of Sellafield’s sustainable travel initiatives and permission would not have been granted other than for use by Sellafield Ltd.

 

Condition 16

The Park and Ride car parking facility shall not become operational until a Transport Movement and Travel Plan has been submitted to and approved in writing by the Local Planning Authority. The development shall be operated in accordance with the approved Plan at all times thereafter.

 

Reason

In the interests of highway safety and to promote sustainable development.

The Panel considered a request to make a Public Footpath Diversion Order under Section 257 of the Town & Country Planning Act 1990 at Mill Hill, Cleator Moor.

 

RESOLVED:- That the request to authorise the making of the Copeland Borough Council Public Footpath No. 403001 Diversion Order No.2 2019 under section 257 of the Town and Country Planning Act 1990 provided that the legal and administration costs in making the order including the relevant advertisement costs are covered by the applicant at an agreed rate be approved.

Consideration was given to a report seeking approval to designate a Tree Preservation Order (TPO) on a sycamore tree situated within the Whitehaven Conservation Area to the west of Castle Park, Whitehaven.

 

RESOLVED – that on a unanimous vote, the designation of a Tree Preservation Order (TPO) on a sycamore tree situated within the Whitehaven Conservation Area to the west of Castle Park, Whitehaven be agreed and the TPO be called The Copeland Borough Council (west of Castle Park, Flatt Walks, Whitehaven) Tree Preservation Order No 01, 2019.
