Members received the Development Management Performance figures for the fourth quarter of 2020/21 (1st January 2021 – 31st March 2021) against the National Performance Indicators.

Following a pause to allow for any Member to indicate otherwise, it was

RESOLVED – that the Development Management Performance Monitoring report be noted and the Planning team be thanked for their continued hard work, particularly in the present time with Covid-19 pandemic restrictions.

Members were informed of the outcome of a recent Appeal decision in respect of Land off Arlecdon Parks Road, Frizington, Cumbria.

RESOLVED – that the decision to DISMISS the appeal be noted in the context of the Local Plan Policies and also in relation to performance monitoring.

Members considered some minor changes proposed to chapter 10 of

the constitution relating to planning matters.

 

During the discussion, a number of points were raised, which the Solicitor agreed to look at further.

 

A vote was then taken, by way of a roll call.

 

The result of the vote was 9 For, 0 Against and 0 Abstentions.

 

RESOLVED That the proposed changes to chapter 10 of the Constitution as set out in the supplementary agenda report be recommended to the Standards and Ethics Committee, then Council for approval subject to:

a)                 Within the Decisions Contrary to Officer recommendations section, where a ‘Minded to’ decision is made, if the application has not been referred back to the panel by the third meeting, a holding report be presented.

b)                 Within the Decisions contrary to Officer recommendations section, Point 6 be amended to read “In recording the resolutions on such application where members refuse planning permission against the Officer recommendation the minutes must set out a full, clear and detailed statement of the reasons for the departure from policy from each member voting to refuse. This will provide the basis of the Council’s defence to any appeal which may be lodged against refusal.
