Appointment of Chair for the Meeting

Minutes:

It was moved by Councillor Graham Sunderland duly seconded and

 

RESOLVED – That Councillor Martin Barbour be appointed Chairman for the meeting.

Declarations of Interest

Minutes:

Councillors Martin Barbour, Gwynneth Everett, Dave Rile and Graham Sunderland declared interest in Agenda item 4 due to knowing the complainants and Members involved.

STA3

Exclusion of Press and Public

Under section 100 (a) (4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items on grounds that, if they were present, there could be disclosure to the exempt information as defines in the relevant paragraphs of Schedule 12A of the Act.

Minutes:

It was in the opinion of Members that it was not in the public interest to consider any of the complaints as set out in Agenda item 4 in public it was therefore moved duly seconded and

 

RESOLVED – That the press and Public be excluded for the remaining items of business in view of likely disclosure of exempt information as defined in paragraphs 1-3 of part 1 of Schedule 12A of the Local Government Act 10872 (as amended).

To consider Code of Conduct Complaints

Minutes:

Prior to the commencement of consideration of this item it was noted that complaints 4,5,6,7 and 10 would not be considered due to either the named Member or the complainant not being able to attend the meeting.

 

It was agreed that Complaint 2 would be considered first on the agenda.

 

Reference Documents

Code of Conduct for Copeland Borough Council and Whitehaven Town Council were received and noted as background Documents.

Complaint 2

 

Prior to the commencement of the consideration of this complaint Members introduced themselves to the named member and complainant.  Anthony Payne confirmed that he was independent member who was attending to observe, challenge and advise.

 

The Chairman advised the named Member and complainant that the meeting was in private and recording was strictly prohibited.  The named member, complainant, Members of the Committee, independent person and officers all confirmed that they were not recording the proceedings.

 

Consideration was then given to an allegation that the named Member had commented that Labour Councillors were “acting like children” by asking for a second adjournment during a meeting of Full Council the word “stupid” was heard although it was unclear as to the context.

 

The Commercial Manager presented the detail of the complaint received and the procedure evidence collated stating from who and when.

 

A full questioning and open debate then took place during which the named Member offered a full apology stating that his comments had been made out of frustration and not as a derogatory comment towards the complainant personally or the Labour Group as a whole. He added that he had the utmost respect for the complainant and the work he did for the Council.

 

The complainant accepted the apology fully.

 

The named Member, complainant and Commercial Manager left the room at this point to allow the Members of the Committee to deliberate and reach a decision.

 

The named Member, complainant and commercial manager returned to the meeting.

 

In summing up the Chairman stated that both the complainant and named Member had conducted themselves professionally and said that it was regrettable that this situation could not have been resolved without having to be put to committee.  It was then

 

RESOLVED – That the there was no breach of the code of conduct and no further action would be required.

 

The Sub Committee in noting that this complaint should have been dealt with earlier in the procedure through informal facilitation so as not to reach this formal meeting stage wished to review the procedure to reflect this.
