Minutes:

Consideration was given to the minutes of the meeting held on 20 July 2021.

 

RESOLVED:- that the minutes of the meeting held on 20 July 2021 be signed by the Chair as a correct record, subject to minute SEC 21/10 being amended to show Councillor Hully as a Director of Regeneration NE Copeland.

 

SEC 21/23

Exclusion of Press and Public

The Chair to move:

That under Section 100(a)(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following item on the grounds that, if they were present, there could be disclosed to them exempt information as defined in the relevant paragraphs of Schedule 12A of the Act.

Minutes:

RESOLVED – that the press and public be excluded for the remaining items of business in view of the likely disclosure of exempt information as defined in paragraphs 1, 2 and 3 of schedule 12A of the Local Government Act 1972.

Code of Conduct Complaints

Minutes:

The Code of Conduct complaints were considered in the following order.

 

SEC 21/25

Complaint 1

Minutes:

Neither the Complainant or Subject Member were present and no apologies had been received. The committee agreed to continue and hear the complaint in their absence.

 

Consideration was given to an allegation that the subject Member had breached the Council’s Code of Conduct.

 

The Council’s Solicitor commenced the hearing by setting out the details of the complaint to the Committee.

 

At this point the committee deliberated and considered their decision.

 

At the conclusion of the deliberations it was

 

RESOLVED – that the Committee unanimously agreed that there had been no breach of the code of conduct.

 

SEC 21/26

Complaint 2

Minutes:

Prior to the commencement of the consideration of the complaint, Members were introduced to the Complainant, the Complainant’s supporter and Subject Member. 

 

Consideration was given to an allegation that the subject Member had breached the Council’s Code of Conduct.

 

The Council’s Solicitor commenced the hearing by setting out the details of the complaint to the Committee.

 

The Complainant and Subject Member then each had fifteen minutes to present their case to the Committee.

 

The Committee members were provided with the opportunity to ask questions of the Complainant and subject Member.

 

At this point it was suggested that the committee deliberate and consider their decision. The Complainant and Subject Member were advised that the decision would be sent to them in writing after the meeting and both then left the meeting.

 

At the conclusion of the deliberations it was:

 

RESOLVED – that the Committee unanimously agreed that there had been no breach of the code of conduct.
